Abstract

يعتبر المستهلك الطرف الضعيف في العلاقة التعاقدية، الأمر الذي يجعله جدير بحماية المشرع له، وفي المجال العقاري تعد العلاقة بين مقتني العقار والمتدخل المحترف علاقة إستهلاكية يأخذ فيها المقتني وصف المستهلك العقاري. يهدف موضوع الدراسة إلى البحث عن الآليات المكرسة لحماية المستهلك العقاري من التصرفات العقارية التي يقوم بها المتدخل العقاري عن طريق البيع من خلال قواعد الترقية العقارية، التي من شأنها إلحاق الضرر بالمستهلك العقاري وتعريضه لعدم حصوله على العقار السكني من جهة، وضياع أمواله من جهة أخرى، خاصة في عقود بيع العقارات غير المنجزة

Dans le domaine immobilier, la relation entre l’acquéreur immobilier et l’intervenant professionnel est une relation de consommation dans laquelle l’acquéreur reprend la description du consommateur immobilier. L’objectif de l’etude est de rechercher des mécanismes dédiés à la protection du consommateur immobilier contre transactions immobilieères réalisées par l’investisseur immobilier à travers la vente selon les règles de la promotion immobilère, qui causeraient un préjudice au consommateur immobilier et exposeraient lui au risque de ne pas obtenir le bien d’une part et de perdre son argent d’autre part, notamment contrats de vente immobilière inachevés
