مقاصد الزواج وأثرها في المستجدات العلمية المعاصرة -دراسة مقارنة بقانون الأسرة الجزائري // The purposes of marriage and its impact on contemporary scientific developments -A comparative study of the Algerian Family Law-

Abstract

جعل الشارع الحكيم لعقد الزواج مقاصدسامية إذا روعيت حقق الزواج آثاره في المجتمع - والتي من بينها حفظ النسل والنسب ، والتي تعتبر من أعظم المقاصد المتوخاة وغير ذلك -، وإذا أهملت تلك المقاصد، أو أٌخل بها لم يتحقق المعنى المقصود من الزواج، وتعطلت الحياة وظهرت المشكلاتالأسرية والاجتماعية، وتزداد هذه المشكلات على حسب ما يُهمل من تلك المقاصد من حيث هي ضرورية أو تحسينية وغير ذلك ، وتظهر أهمية مقاصد الزواج في علاج أحكام ما طرأ من مستجدات علمية معاصرة تمس كيان الأسرة مثل الزواج الالكتروني و الفحص الطبي قبل الزواج وكذا مامس آثار الزواج خاصة فيما يتعلق بالنسب وماطرأ على ذلك من مستجدات طبية . و من هذا فتبرز ضرورة تفعيل علم مقاصد الشريعة والتأكيد على ربط المقاصد بالأحكام الشرعية عند تناولها ودراستها، كما يجب ربطها أيضا بالعلوم الكونية،فالعلوم بصفة عامة يكمل بعضها بعضا مما ينتج عنه فهما كليا ونظرة شمولية عند الفقيه والعالم على حد سواء

The Shari'ah has set lofty purposes for the marriage contract, and if these purposes are observed, marriage will achieve its effects in society, including the preservation of offspring and lineage, which is one of the greatest purposes to be achieved. If these purposes are neglected or violated, the intended meaning of marriage is not achieved, life is disrupted and family and social issues arise, and these issues increase according to what is neglected of these purposes in terms of necessity or improvement and others, and the importance of the purposes of marriage appears in addressing the provisions of contemporary scientific developments that affect the family entity, such as electronic marriage and medical examination before marriage, as well as the effects of marriage, especially in terms of lineage and the latest medical developments that have occurred in this regard. From this, the need to activate the science of the Maqasid al-Sharia and emphasize linking the Maqasid to the Sharia provisions when dealing with them and studying them, as well as linking them to the cosmological sciences, as the sciences in general complement each other, which results in a holistic understanding and a holistic view for the jurist and the scientist alike

La charia a fixé de nobles objectifs au contrat de mariage, et si ces objectifs sont respectés, le mariage produira ses effets dans la société, y compris la préservation de la descendance et de la lignée, qui est l'un des objectifs les plus importants à atteindre. Si ces objectifs sont négligés ou violés, le sens du mariage n'est pas atteint, la vie est perturbée et des problèmes familiaux et sociaux apparaissent, et ces problèmes augmentent en fonction de ce qui est négligé dans ces objectifs en termes de nécessité ou d'amélioration et autres, et l'importance des objectifs du mariage apparaît dans le traitement des dispositions des développements scientifiques contemporains qui affectent l'entité familiale, tels que le mariage électronique et l'examen médical avant le mariage, ainsi que les effets du mariage, en particulier en termes de lignée et les derniers développements médicaux qui ont eu lieu à cet égard. D'où la nécessité d'activer la science du Maqasid al-Sharia et de mettre l'accent sur le lien entre le Maqasid et les dispositions de la charia lorsqu'on les traite et les étudie, ainsi que sur le lien avec les sciences cosmologiques, car les sciences en général se complètent mutuellement, ce qui aboutit à une compréhension et à une vision holistiques pour le juriste comme pour le scientifique
