دور التدقيق الجبائي في تسيير وادارة المخاطر الجبائية للمؤسسات الاقتصادية - دراسة حالة // The Role of Tax Auditing in Managing and Handling Tax Risks of Economic Institutions -A Case Study -

Abstract

تسعى هذه الدراسةإلى إبراز دور التدقيق الجبائي في تسير وإدارة المخاطر الجبائية للمؤسسة الاقتصادية، من خلال التركيز على التدقيق الجبائي في المؤسسات الاقتصادية الجزائرية ومعرفة الدور الذي يؤديه في التحكم في المخاطر الجبائية. ولتحقيق أهداف هذه الدراسة ولتدعيم الجوانب النظرية تم القيام بدراسة حالة من خلال فحص الجوانب المحاسبية والجبائية وكذا الجوانب المتعلقة بالفعالية الجبائيةلمؤسسة الدراسة،حيث خلصت نتائج الدراسة إلى امتثال مؤسسة الدراسة للتشريع الجبائي وهو ما جنبها المخاطر الجبائية المرتبطة بالعقوبات والغرامات، ومن ناحية الخيارات الجبائية لم تستغل مؤسسة الدراسة الفرص الجبائية المتاحة المتعلقة بالاستثمار ولم تستفد من التخفيضات المتعلقة بإعادة استثمار الأرباح وهذا عرضها لمخاطر دفع تكاليف اضافية، ويتبين من خلال ما سبق أن المؤسسة الاقتصادية الجزائرية تهتم بمخاطر عدم الامتثال لتشريع الجبائي وتهمل المخاطر المتعلقة بالخيارات الجبائية. كما تم تدعيم دراسة الحالة بدراسة استقصائية (استبيان) والتي أكدت وجود علاقة طردية قوية بين التدقيق الجبائي وإدارة المخاطر الجبائية وعليه فالتدقيق الجبائي هو آلية تعمل على الحد من المخاطر الجبائية في المؤسسة الاقتصادية.

This study aims to highlight the role of tax auditing in managing and controlling tax risks in economic enterprises by focusing on tax auditing in Algerian economic institutions and understanding its role in tax risk management. To achieve the objectives of this study and support the theoretical aspects, a case study was conducted by examining the accounting and tax aspects, as well as the tax efficiency of the studied institution. The study's findings concluded that the institution complies with tax legislation, which has helped it avoid tax risks related to penalties and fines. However, in terms of tax options, the institution did not take advantage of the available tax opportunities related to investment and did not benefit from the reductions associated with reinvesting profits, exposing it to the risk of incurring additional costs. From the above, it becomes evident that Algerian economic institutions focus on the risks of non-compliance with tax legislation while neglecting the risks associated with tax options. The case study was also supported by a survey (questionnaire), which confirmed a strong positive relationship between tax auditing and tax risk management. Accordingly, tax auditing serves as a mechanism to mitigate tax risks within economic institutions.

Cette étude vise à mettre en évidence le rôle de l'audit fiscal dans la gestion et l'administration des risques fiscaux au sein de l'entreprise économique, en se concentrant sur l'audit fiscal dans les entreprises économiques algériennes et en examinant le rôle qu'il joue dans le contrôle des risques fiscaux. Pour atteindre les objectifs de cette étude et appuyer les aspects théoriques, une étude de cas a été réalisée en examinant les aspects comptables et fiscaux ainsi que ceux liés à l'efficacité fiscale de l'entreprise étudiée. Les résultats ont montré que l'entreprise respecte la législation fiscale, ce qui lui a permis d'éviter les risques liés aux sanctions et aux amendes. Cependant, en ce qui concerne les choix fiscaux, l’entreprise n’a pas exploité les opportunités fiscales disponibles en matière d’investissement et n’a pas bénéficié des réductions liées à la réinjection des bénéfices, ce qui l’a exposée au risque de coûts supplémentaires. Il ressort de cela que l’entreprise économique algérienne accorde de l’importance aux risques liés au non-respect de la législation fiscale, mais néglige les risques associés aux choix fiscaux. L’étude de cas a été complétée par une enquête (questionnaire) qui a confirmé l’existence d’une forte corrélation positive entre l’audit fiscal et la gestion des risques fiscaux. Par conséquent, l’audit fiscal constitue un mécanisme permettant de réduire les risques fiscaux dans l’entreprise économique.
