البعد المقاصدي لحماية حقوق الطفل في الفقه الإسلامي والتشريع الجزائري

Abstract

إن المقاصد هي روح الشريعة الإسلامية وحكمها وغايتها ومراميها وأصولها الكبرى وأسسها العظمى وأركانها التي لا تبلى وفروعها المتغيرة حسب الزمان والمكان مراعاة لحالة الإنسان فهو محور وهدف الرسالة الإسلامية إذ حرصت على رعايته وأوجبت له الحماية في مختلف مراحله العمرية خاصة في بدايتها من تنشئة سليمة صحيحة محاطة بمجموعة من الحقوق نص عليها القرآن والسنة النبوية الشريفة. إذ وضع الدين الإسلامي نظام دقيق محكم لحمايته منذ تكوين الأسرة إلى نشأته في رحم أمه إلى أن يخرج إلى الوجود بشرا سويا. فالطفل مخلوق ضعيف له حقوق أصيلة إنسانية أساسية ينبغي أن تتظافر جهود الجميع لتحقيقها وصيانتها وضمان تمتعه بها إذ اتفقت كل الشرائع الإلهية و القوانين الوضعية فوضعت أحكام شرعية تحفظ لهم ذلك وتكفل رعايتهم، وإتخذها العلماء والمشرعين القانونيين أساسا لوضع منظومات قانونية تصبو إلى تحقيق مصلحة الطفل الفضلى فهي واجب كل فرد من قريب أو من بعيد نحوه.

The intentions is the basic of Islamic religion and his judgments, purposes, targets and his great origins and staffs which doesn't getting old according to the time and the place, by get attention for the state of the human, who is presented the axe and the aim of the Islamic message. so it's tried hard to protect him during his deferent ages sequences, particularly in his beginning, for a correctly development turning by a rights based from Quran and Sunnah. The Islamic religion has established an accurate system to protect the human being, since the made of the family, to his creature in his mother womb, till his coming to the exist. the child is a weak creature has his own basic rights as a human, which should all the people enhance the efforts to be realized, and guarantied, according to all religions of God and laws, which is agreed that his rights should be kept, so the specialists of law take it as a basic to establish legal sources legislation that realize the child's interests, which is a duty to every individual.

Les intentions sont la base de la religion islamique et de ses jugements, buts, cibles et ses grandes origines, et ces sujets qui ne vieillissent pas en fonction du temps et du lieu de la condition de l'être humain, qui est le centre du message islamique, en lui offrant une protection au cours de ses différons âges, en particulier dans son début de naissance, le message islamique l'a établi correctement avec des groupes de droits émis par le CORAN et la Sunna Du Prophète. La religion islamique a mis en place un système précis de protection de l'être humain, depuis son début de croissance dans le ventre de sa mère, et dans son enfance Jusqu'à ce que l'enfant soit un homme complet, et il réjouit de ses propres droits fondamentaux en tant qu'être humain. L'enfant et une créature faible, la société doit renforcée les efforts à réaliser et à conserver ces droits, conformément à toutes les religions de Dieu et les lois, qui ont convenu que ses droits devraient être préservés; or que les spécialistes du droit étant à la base de la mise en place d'une législation relative aux sources juridiques de l'intérêt de l'enfant et de sa protection, qui ont démontré que c'est le devoir de chaque individu.
