أثر النظام القانوني المالي على ترقية الاستثمار في الجزائر

Abstract

تندرج أهمية البحث ضمن الإصلاحات المتخذة من طرف المشرّع الجزائري خلال مسيرة تطور القوانين المتعلقة بإنعاش الاقتصاد الوطني منذ فترة طويلة، حيث شهد الاستثمار بأنواعه محاولات جذبة قانونية لإزالة المعوّقات وخلق نوع من التحفيزات لاسيما ما يتعلق بالجانب المالي من خلال الإصلاحات الضريبية و الجبائية و التعديلات المتلاحقة لقوانين المالية ضمن محاولة إنشاء منظومة قانونية متكاملة للاستثمار و تعتبر ترقية الاستثمار من أولى الأولويات لدى الدول التي تسعى لتطوير اقتصادها خارج نظام المحروقات خاصة أمام عدم استقرار العائدات المتعلقة بها و لا تتحقق هذه الأولوية دون أرضية قانونية متينة خالية من التناقضات أو السلبيات، ومجال البحث هذا يشهد ندرة في الدراسات المتعلقة به. تتمحور الإشكالية الرئيسة للبحث حول مدى مسايرة الإصلاحات المالية القانونية لهدف ترقية الاستثمار و إنعاشه بما يجسد نقلة نوعية في ترسانة القوانين المالية ومدى إمكانية إنشاء منظومة قانونية مالية متكاملة لترقية الاستثمار انطلاقا من الوقوف عند واقعها و سلبياتها و تحدياتها

The investment promotion is one of the country’s top priorities that seek to develop their economy outside the hydrocarbons system, especially in view of the revenues instability related to them. This priority is not achieved without a solid legal framework free of contradictions. The scope of this research is rare in studies related to it, so the problem revolves around the extent to which financial reforms are compatible with the possibility of establishing an integrated financial legal system to promote investment based on their reality, disadvantages and challenges, therefore, so it will be based on the financial legal system related to the investment and the amendments and reforms related to the promotion of investment of all kinds and the detection of their functions and dimensions to determine the impact of investment with these laws negatively and positively and the implications of all this on the national economy to reach the proposal of an integrated legal system to promote investment.
