الوقف ودوره في تحقيق التنمية المستدامة في الجزائر بناءً على تجارب بعض الدول

Abstract

تبحث هذه الدراسة في معرفة الكيفية التي يمكن للوقف من خلالها أن يساهم بصورة فعالة في تحقيق التنمية المستدامة الشاملة، ويأتي هذا من خلال التعريف بمختلف المفاهيم المتعلقة بنظام الوقف وكذا بيان مفهوم التنمية المستدامة، والبحث في العلاقة بينهما، بالإضافة إلى تشخيص واقع قطاع الأوقاف بالجزائر والبحث عن معيقات تطويره وتنميته واستثماره، كما وتهدف هذه الدراسة إلى اقتراح آليات وسبل تمكن من النهوض بدور الوقف بالجزائر لتحقيق التنمية المنشودة، بناءً على الدروس المستخلصة من التجارب الدولية الرائدة، على غرار تجربة الأمانة العامة للأوقاف والصناديق الوقفية بالكويت، وكذا تجربة الوقف النقدي بماليزيا. وخلصت الدراسة إلى أن واقع قطاع الأوقاف بالجزائر مازال يشهد تأخراً كبيراً، مما أدى إلى تراجع دوره المنشود، وذلك راجع لتراكم العديد من المشاكل والمعيقات العالقة به، والتي يمكن تجاوزها من خلال توفير بيئة قانونية ومؤسسية يمكن أن تساهم بفاعلية في النهوض بقطاع الأوقاف وتفعيل دوره،، وكذا من خلال الاستفادة من الدروس المستخلصة من التجارب الدولية محل الدراسة، كتفعيل الوقف النقدي بمختلف أشكاله على ضوء التجربة الماليزية، لما له من دور فعال في إتاحة الفرصة لمختلف شرائح المجتمع للمساهمة في إيجاد أوقاف جديدة، وكذا تطوير العمل المؤسسي الوقفي على ضوء تجربة الأمانة العامة للأوقاف والصناديق الوقفية بالكويت.

Cette étude examine comment les waqfs peuvent contribuer efficacement à la réalisation d'un développement durable global, et cela passe par la définition de divers concepts liés au système waqf ainsi que par l'explication du concept de développement durable et la recherche dans la relation entre eux, en plus du diagnostic la réalité du secteur du waqf en Algérie Et la recherche d'obstacles à son développement, son développement et son investissement, et cette étude vise à suggérer des mécanismes et des moyens de faire progresser le rôle du waqf en Algérie pour atteindre le développement souhaité, sur la base des enseignements tirés des principales initiatives internationales des expériences telles que l'expérience de la fondation publique Awqaf et des fonds waqf et waqf au Koweït, ainsi que l'expérience du waqf en Malaisie. L'étude a conclu que la réalité du secteur du waqf en Algérie connaît toujours un retard important, ce qui a conduit au déclin de son rôle souhaité, en raison de l'accumulation de nombreux problèmes et obstacles qui y sont liés, qui peuvent être surmontés en fournissant un cadre juridique et environnement institutionnel qui peut contribuer efficacement à l'avancement du secteur du waqf et activer son rôle, et aussi, en tirant parti des enseignements tirés des expériences internationales à l'étude, comme l'activation du waqf en espèces sous ses différentes formes à la lumière de la Malaisie l'expérience, en raison de son rôle efficace en offrant la possibilité à différents segments de la société de contribuer à trouver de nouveaux waqfs, ainsi que de développer le travail institutionnel du waqf à la lumière de l'expérience de la fondation publique Awqaf et des fonds du waqf au Koweït.

This study examines how the waqfs can contribute effectively to achieving comprehensive sustainable development, and this comes through the definition of various concepts related to the waqf system as well as explaining the concept of sustainable development and research in the relationship between them, in addition to diagnosing the reality of the waqf sector in Algeria And search for obstacles to its development, development and investment, and this study aims to suggest mechanisms and ways to advance the role of waqf in Algeria to achieve the desired development, based on lessons learned from leading international experiences, such as the experience of Awqaf public foundation and waqf and Waqf funds in Kuwait, as well as the experience of the waqf in Malaysia. The study concluded that the reality of the waqf sector in Algeria is still experiencing significant delay, which led to the decline of its desired role, due to the accumulation of many problems and obstacles related to it, which can be overcome by providing a legal and institutional environment that can contribute effectively to the advancement of the waqf sector and activate its role, And also, through benefiting from the lessons learned from the international experiences under study, such as activating the cash waqf in its various forms in the light of the Malaysian experience, because of its effective role in providing the opportunity for different segments of society to contribute to finding new waqfs, as well as developing the waqf institutional work in the light of experience Awqaf public foundation and waqf funds in Kuwait.
