Abstract:
تناولنا من خلال هذه الدراسة الوضعيات القانونية الأساسية للموظف العام طبقا للمادة 127 من الأمر رقم 06-03 المؤرخ في 15 جويلية سنة 2006 والذي وضعت الموظف في إحدى الوضعيات الآتية: القيام بالخدمة ، الانتداب ، خارج الإطار الإحالة على الاستيداع، الخدمة الوطنية.
وكذلك تطرقنا إلى تحليل الوضعيات من حيث الانقطاع عن الخدمة وحركات نقل الموظف و تمكنا من معرفة الوضعيات التي تسمح للموظف من توقيف العلاقة الوظيفية بصفة مؤقتة مع الإدارة مراعاة لظروفه العائلية والشخصية و هما وضعية الإحالة على الاستيداع و وضعية الخدمة الوطنية.
في مقابل ذلك تجري الإدارة حركة نقل تمس موظفيها سواء ذلك بطلب من الموظف أو في إطار حركة نقل دورية تقتضيها بعض الأسلاك والرتب التابعة للوظيف العمومي، فضلا عن النقل الإجباري لضرورة المصلحة والذي يستفيد الموظف المنقول منه من استرداد نفقات التنقل والمهام طبقا لما نصت المادة 159من الأمر06-03 .
Summary:
Through this study, we dealt with the basic legal situations for public servants according to Article 127 of Ordinance No. 06-03 of 15 July 2006, which placed the employee in one of the following positions: Performing the service, assignment, outside the framework, referral to deposit, national service.
We also discussed the situation analysis in terms of discontinuation from service and employee transfer movements and we were able to know the situations that allow the employee to temporarily suspend the employment relationship with the administration taking into account his family and personal circumstances, namely the status of referral to placement and the status of national service.
In return, the administration conducts a movement of transportation that affects its employees, whether at the request of the employee or within the framework of a periodic transport movement required by some wires and ranks of the public office, in addition to the compulsory transfer due to the necessity of the interest and the employee from which he is transferred benefits from the recovery of transportation expenses and tasks according to Article 159 of the order 06- 03.
