نوازل الأسرة المعاصرة وأحكام تأصيلها في الفقه وقانون الأسرة الجزائري

Abstract

إن التطورات الحديثة التي ميزت عصرنا الحالي مست كل المجالات علميا واقتصاديا واجتماعيا وسياسيا، وقد تأثرت الأسرة بها؛ من خلال نوازل عديدة. فالنوازلهي كل ما يحل بالناس من وقائع جديدة دينية أو دنيوية، لم يسبق لها وجود واقعي ولا حكم شرعي، وتحتاج إلى استفراغ الوسع استنباطا وتطبيقا. ويهدف البحث إلى تسليط الضوء على النوازل المعاصرة الخاصة بالأسرة والتعرف علي بعضها مع بيان الحكم الفقهي والقانوني لها. ويمكن تمييزها من خلال تصنيفين: منها ما كان متعلقا بالنوازل الطبية كالتلقيح الصناعي واستئجار الأرحام، والفحص الطبي قبل الزواج، والتفريق بين الزوجين بسبب مرض الإيدز ومنها ما كان متعلقا بالحياة الزوجية انعقادا، كالزواج الالكتروني، والزواج بنية الطلاق، ومشاركةً كنفقة الزوجة العاملة،وأثرَ انحلالِها كزيارة المحضون في زمن الأوبئة -كورونا أنموذجا-

Les développements récents qui ont caractérisé notre époque actuelle ont touché tous les domaines scientifiquement, économiquement, socialement et politiquement, et la famille en a été affectée. à travers de nombreux cataclysmes. Les calamités sont tout ce qui arrive aux gens en termes de nouveaux événements religieux ou mondains qui n'ont pas eu auparavant une existence réaliste ou une décision légale, et ils doivent être épuisés en déduction et en application.
