تطور الميزانية العامة في الجزائر مابين قنون 84-17 والقانون العضوي18-17

Abstract

تهدفهذهالدراسةإلىتسليطالضوءعلىمسارتطورالميزانيةالعامةفيالجزائرمنخلالالمقارنةبينقانون 17-84،الذيمثّلالإطارالقانونيالكلاسيكيللماليةالعامة،والقانونالعضوي 15-18،الذيجاءفيسياقإصلاحييهدفإلىتحديثنظامإعدادوتنفيذومراقبةالميزانية. ركزتالدراسةعلىتحليلالأبعادالقانونيةوالتنظيميةوالتطبيقيةالتيأفرزهاالانتقالمنمنطقتقليديقائمعلىالمحاسبةوالإدارةالشكليةإلىمنطقحديثيربطالميزانيةبالأداءوالنتائج. كماتناولتالدراسةالتحدياتالمرتبطةبتفعيلالإصلاحاتالجديدة،ومدىاستعدادالبيئةالمؤسسيةوالإداريةفيالجزائرلتجسيدمبادئالشفافية،الفعالية،والحكامةالجيدة. وتوصّلتإلىأننجاحهذاالتحولمرهونبإرادةسياسيةقوية،وقدرةعلىتجسيدالنصوصالقانونيةفيممارساتفعليةتخدمالتنميةالمستدامة.

Abstract: This study aims to shed light on the evolution of the general budget in Algeria by comparing Law 17-84, which represented the classical legal framework of public finance, with Organic Law 15-18, introduced as part of a broader reform to modernize the process of budget preparation, execution, and control. The research focuses on analyzing the legal, organizational, and practical dimensions of the shift from a traditional logic based on accounting and formal administration to a modern approach centered on performance and results. It also examines the challenges facing the implementation of the new reforms and assesses the readiness of Algeria’s institutional and administrative environment to uphold the principles of transparency, efficiency, and good governance. The study concludes that the success of this transformation depends on strong political will and the effective translation of legal texts into practical actions that support sustainable development.
