Abstract:
تناولنا في هذا البحث إشكالية الطبيعة القانونية لرقابة المجلس الدستوري والتي هي في الحقيقة تتعلق في النهاية بالتوازن بين الطابع القضائي والسياسي للهيئة المكلفة بمهمة الرقابة. على اعتبار أن الرقابة على دستورية القوانين هي الآليةالضامنة لسمو الدستور من خلال احترام قواعده من طرف السلطات العامة وبالخصوص من قبل السلطة التشريعية فيما تسنه من قوانين، حيث أن المجلس الدستوري يتسم في بعض جوانبه بالطابع القضائي الذي من المفترض أن يمنحه نوعا من الاستقلالية والقوة في مهمة حماية الدستور، إلا أن هذا لا يمنع من وجود اعتبارات سياسية يمكن أن تؤثر في تكوينه العضوي أو في الإجراءات المتبعة في تأديته لمهامه تضفي عليه الطبيعة السياسية. ليبقى الهدف الأساسي هو الموازنة بينهما من أجل حماية الدستور من جهة وتحقيق العدالة وحماية الحقوق والحريات من جهة أخرى.
In this research, we addressed the issue of the legal nature of the Constitutional Council's oversight, which ultimately concerns the balance between the judicial and political aspects of the body entrusted with this oversight role. The oversight of the constitutionality of laws is the mechanism that guarantees the supremacy of the constitution by ensuring that its rules are respected by public authorities, especially the legislative authority in the laws it enacts. While the Constitutional Council, in some aspects, has a judicial nature that is supposed to grant it a degree of independence and strength in its task of protecting the constitution, this does not preclude the existence of political considerations that may influence its composition or the procedures it follows in performing its duties, thus giving it a political nature. The ultimate goal remains to balance these aspects in order to protect the constitution on the one hand, and to achieve justice and protect rights and freedoms on the other.
Danscet article, nous abordons le problème de la nature juridique du contrôle du Conseil constitutionnel, qui concerne en fin de compte l’équilibre entre le caractère judiciaire et politique de l’organe chargé du contrôle. Considérant que le contrôle de la constitutionnalité des lois est le mécanisme qui garantit la suprématie de la Constitution par le respect de ses règles par les autorités publiques, en particulier par l’autorité législative dans les lois qu’elle promulgue, comme le Conseil constitutionnel se caractérise à certains égards par un caractère judiciaire qui est censé lui donner une sorte d’indépendance et de pouvoir dans La mission de protéger la constitution Cependant, cela n’empêche pas l’existence de considérations politiques qui pourraient affecter sa composition organique ou les procédures suivies dans l’exercice de ses fonctions qui lui confèrent un caractère politique. L’objectif principal reste de les équilibrer afin de protéger la constitution d’une part et de parvenir à la justice et de protéger les droits et libertés d’autre part.
