الشروط الموضوعية والشكلية لعقد الزواج وانحلاله في قانون الاسرة الجزائري //The substantive and formal conditions of marriage contract and its dissolution in Algerian family law

Abstract

عقد الزواج هو رباط مقدس بين الرجل والمرأة وقد شرعه الله وجعله ميثاقا غليظا بينالزوجين، والهدف منه هو الاستقرار النفسي والروحي، وتكوين أسرة أساسها المودة والرحمة والمحافظة على الأنساب، ويكون عقد الزواج صحيحا،إن توفرت الأركان والشروط المنصوص عليها في المادتين 9 و9 مكرر من قانون الأسرة الجزائري. ولتحقيق هدف الموضوع تم تقسيم الدراسة إلى بابين، الباب الأول تناولنافيه الشروط الموضوعية والشكلية لعقد الزواج وآثاره، وقمنا بتقسيمه إلى فصلين، تطرقنا في الفصل الأول إلى الشروط الموضوعية لإنشاء عقد الزواج، بينما خصصنا الفصل الثاني للشروط الشكلية في عقد الزواج وآثاره،أما الباب الثاني كانعنوانه انحلال عقد الزواج وآثاره، وقد تم تقسيمه إلى فصلين، تطرقنا في الفصل الأول إلى طرق انحلال الرابطة الزوجية، أما الفصل الثاني فتناولنا فيه آثار انحلال الرابطة الزوجية واجراءات الصلح بين الزوجين، وفي ختام الدراسة عرضنا أهم النتائج التي توصلنا إليها إلى جانب بعضالإقتراحات والتوصيات

The marriage contract is a sacred bond between a man and a woman, and God has made it a solemn covenant between the spouses. Its goal is psychological and spiritual stability, and the formation of a family based on love, mercy, and the preservation of lineage. The marriage contract is valid if the pillars and conditions stipulated in Articles 9 and 9 bis of the Algerian Family Law are met. To achieve the objective of the subject, the study was divided into two chapters. The first chapter dealt with the objective and formal conditions of the marriage contract and its effects. We divided it into two sections. In the first chapter, we addressed the objective conditions for establishing the marriage contract, while we devoted the second chapter to the formal conditions in the marriage contract and its effects. The second section was entitled Dissolution of the Marriage Contract and its Effects. It was divided into two sections In the first chapter, we addressed the methods of dissolution of the marital bond in the second chapter, we addressed the effects of dissolution of the marital bond and the procedures for reconciliation between the spouses. At the end of the study, we presented the most important results we reached, along with some suggestions. And recommendations

Le mariage est un lien sacre entre l'homme et la femme instauré par Dieu et faisant de lui impacte solennel entre les époux. Son but est la stabilité psychologique et spirituelle, ainsi que la formation d'une la famille fondée sur l'affection, la miséricorde et la préservationdes lignées.Le contrat de mariage est valable si les éléments et les conditions prévues avec articles 9 et 9 bis du code de la famille algériennesont remplis, pour atteindre l'Objectif de sujet, il a été divisé endeux parties. Dans la première partie, nous avons abordéles conditions matérielles et formelles du contrat de mariage ainsi que ses effets, et nous avons divisée en deuxchapitres, Dans le premier chapitre nous avons abordéles conditions objectives de la conclusion du contrat de mariage, tandis que le deuxième chapitre est consacréauxconditions formelles du contrat de mariageet à ses effets. Quant à la deuxième partie, elle porte sur la dissolution du contrat de mariage et ses effets, et elle a également été divisée en deux chapitres, le premierchapitre examine les différentes façons de dissoudre lien conjugal,Tandis que le deuxième chapitre aborde les effets de la dissolution du lien conjugal et les procédures de réconciliation entre lesépoux. Enfin, à la fin de l'étude, nous avons présenté les résultats les plus importants auxquelsnous sommes parvenus, accompagnés de quelques suggestions et recommandations
