الملخص
. كان المجالس القضاء والتنظيم القضائي في القضاء خلال عصري الإمارة والخلافة دور كبير وكلي في تنشأت مؤسسة قضائية متكاملة الأركان بفضل طاقم متخصص وأرشيف منظم وقوانين محددة وكل هذا بفضل الخبرة الفقهية.
. من خلال القضايا السياسية والاجتماعية التي تناولها القضاء في العصر الأندلسي
( عصري الإمارة و الخلاقة ) فأنا تكون قد كشفنا أن القضاء مؤسسة لها تقلها المستقل الذي جمع بين الدور الاجتماعي ( صون الأسرة ، حماية ، الملكية . ضبط السلوك العام ) ، و الدور السياسي ( تقييد السلطة ، حدود الشرع ، و الدفاع عن حقوق الأفراد أمام الدولة ) و الدو الحضاري من خلال فقه قضائي راق و
موثق .
لقد ساعدت كتب النوازل الأندلسية على فهم الواق القضائي لأهل الذمة و ما واجهه القضاء من تحديات الزمتهم الاجتهاد الشخصي و الفقهي حل مشاكل كل فئات المجتمع المتباينة ( تعيين أو مسلمين ) .
لقد كان المذهب المالكي هو الركيزة الأساسية التي اعتمدها القضاء والفقهاء في الحكم في القضايا التي تواجها المجتمع وذلك لما حمله من عدالة و نزاهة التي كان مصدرها الشريعة الإسلامية .
The judicial councils and the judicial organization during the periods of the Emirate and the Caliphate played a major and integral role in establishing a fully-fledged judicial institution. This was achieved thanks to a specialized staff, an organized archive, and defined laws—all driven by profound jurisprudential expertise.
Through the political and social cases handled by the judiciary during the Andalusian era (the Emirate and Caliphate periods), we reveal that the judiciary was an institution of independent weight. It bridged a social role (preserving the family, protecting property, and regulating public behavior), a political role (limiting authority within the boundaries of Sharia and defending individual rights against the state), and a cultural/civilizational role through a sophisticated and documented judicial jurisprudence.
Andalusian Nawazil books (records of judicial precedents and legal responses) have greatly helped in understanding the judicial reality of the Dhimmi (non-Muslim citizens under Islamic rule). They also highlight the challenges faced by the judiciary, which compelled judges to employ personal and jurisprudential reasoning (Ijtihad) to solve the problems of all diverse segments of society, whether they were Christians or Muslims.
The Maliki school of thought (Madhhab) was the fundamental pillar adopted by the judiciary and jurists to adjudicate the cases facing society. This was due to the justice and integrity it embodied, both of which were derived directly from Islamic Shari
