القوانين االستثنائية الفرنسية في الجزائر وآثرها االجتماعي واالقتصادي )قانون الحالة المدنية 1882م ( نموذجا

Abstract

تتناول هذه الدراسة "القوانين الستثنائية الفرنسية في الجزائر وآثارها الجتماعية .ً ً تحليليا والقتصادية"، متخذة من "قانون الحالة المدنية الصادر في 23 مارس 1882" نموذجا برز الد ارسة كيف تحولت هذه الترسانة التشريعية من مجرد غطاء إداري إلى سالح استعماري ُ ت ممنهج إلحكام السيطرة الشاملة؛ فمن الناحية الجتماعية، استهدف قانون 1882 تفكيك البنية القبلية وطمس الهوية العربية اإلسالمية عبر فرض ألقاب هجينة ومشتتة لألنساب. ومن الناحية ً لكسر نظام الملكية الجماعية )أ ارضي العرش( لتسهيل ّل القانون تمهيدا القتصادية، شك مصادرتها ومنحها للمستوطنين. وتخلص الدراسة إلى أن هذه القوانين الستثنائية أسست لنظام تشريعي عنصري، جعل من "الستثناء "قاعدة لشرعنة السيطرة، وتدمير البنى الحيوية للمجتمع ً الج ازئري اقتصاديا . ً واجتماعيا Abstract: This study examines the socio-economic repercussions of French exceptional legislation in colonial Algeria, focusing on the Civil Status Law of March 23, 1882, as an analytical model. It demonstrates how this legislative arsenal transcended its ostensible administrative purpose to become a systematic colonial mechanism for total control. Socially, the 1882 law sought to dismantle the indigenous tribal structure and erase Algerian Arab-Islamic identity by imposing disparaging, arbitrary family names that fractured ancestral lineages. Economically, the law served as a precursor to breaking the traditional system of collective land tenure (Arch lands), thereby facilitating their expropriation and redistribution to European settlers. The study concludes that this exceptional legislation institutionalized a discriminatory legal framework, turning "exceptional measures" into a permanent rule to legitimize dominance and undermine the vital socioeconomic foundations of Algerian society
