الاختصاص التشريعي للبرلمان الجزائري : على ضوء التعديل الدستوري لسنة 2016

Abstract

هذا البحث يخوض في دراسة عمل البرلمان في المجال التشريعي، وحقيقة سيادة البرلمان وتمكنه من الاختصاص التشريعي المنوط به دستوريا من خلال القواعد التي تحكمه وتنظم سير العملية التشريعية, في ظل العوامل التي تحدد مستوى أدائه, خاصة مع إشراك السلطة التنفيذية في كل مجريات العملية التشريعية إلى حد أدى إلى انفلات الاختصاص التشريعي من البرلمان, رغم ما جاء به التعديل الدستوري لسنة 2016 من تدعيم للبرلمان.

Cette recherche examine le travail du Parlement dans le domaine législatif: le fait que le Parlement ait le pouvoir et l'autorité d'exercer les pouvoirs législatifs qui lui sont conférés par la constitution, conformément aux règles qui régissent et réglementent le fonctionnement du Parlement, malgré la modification constitutionnelle de l'année 2016 du renforcement du Parlement

This research investigates the work of the work the Parliament in the legislative sphere; the fact that the Parliament has the power to legislate constitutionally by means of the rules that govern it and regulate the process of the legislative process; the legislative process to the point that led to the separation of legislative jurisdiction from Parliament, despite the constitutional amendment of the year 2016 in support of Parliament.
