الاشكالات القانونية لإعتماد الحوكمة الالكترونية في الجزائر

Abstract

تعالج هذه الدراسة مدى ملائمة الاطار التشريعي في الجزائر لسيرورة وعمل الحكومة الالكترونية كأحد أهم الركائز الأساسية التي يقوم عليها هذا المشروع الواعد الذي ينتظر منه اعادة بعث الثقة بين المواطن والحكومة وتسهيل حياة المواطن في علاقته مع الحكومة، وهذا بتسليط الضوء على أهم الإشكالات القانونية التي من شأنها اعاقة تجسيد الحكومة الإلكترونية وكذا على أهم الفراغات القانونية التي تعاني منها المنظومة التشريعية في هذا المجال وهذا من أجل اقتراح الحلول الكفيلة بإيجاد الأدوات القانونية الملائمة لعمل الحكومة الإلكترونية وحمايتها. This study examines the appropriateness of the legislative framework in Algeria for the process and work of e-government as one of the most important pillars on which this promising project is based, which is expected to restore confidence between the citizen and the government and facilitate the life of the citizen in his relationship with the government, and this sheds light on the most important legal problems that would Obstructing the embodiment of e-government as well as the most important legal void experienced by the legislative system in this field, and this is in order to suggest solutions to find appropriate legal tools for the work and protection of e-government

Cette étude examine la pertinence du cadre législatif en Algérie pour le processus et le travail de l'e-gouvernement comme l'un des piliers les plus importants sur lesquels repose ce projet prometteur, qui devrait restaurer la confiance entre le citoyen et le gouvernement et faciliter la vie du citoyen dans sa relation avec le gouvernement, et cela met en lumière les problèmes juridiques les plus importants qui Obstruer l'incarnation de l'e-gouvernement ainsi que le vide juridique le plus important rencontré par le système législatif dans ce domaine, et ce afin de proposer des solutions pour trouver les outils juridiques appropriés pour le travail et la protection de l'e-gouvernement.
