Abstract:
لقد عرفت التجربة الدستورية الجزائرية ترجيحا واضحا لكفة السلطة التنفيذية لاسيما مؤسسة رئيس الجمهورية الذي كان ولا يزال يحتل مركزا قانونيا مرموقا في النظام السياسي الجزائري، نظرا لتلك الأهمية التي أولاه إياها المؤسس الدستوري، سواء من حيث نمط اسناد السلطة وكيفية توليه لهذا المنصب وما يستوجبه من شروط مضيقة لحق الترشح، أو من خلال تنظيمه للعملية الانتخابية المفضية إلى عهدة رئاسية طالما شكلت تذبذبا حول مسألة الإطلاق والتقييد، أو من خلال ذلك الزخم الكبير من الصلاحيات التي خوله إياها سواء في الظروف العادية أو الاستثنائية، في ظل تراجع دوري البرلمان والوزير الأول من جهة، ومن جهة أخرى في ظل ذلك التغييب الكامل للنص على مسؤوليته، مما يجعل من الصعوبة بما كان تحديد طبيعة النظام السياسي الجزائري كونه يأخذ من كل نمط ما يعزز ويقوي المركز القانوني له.
L’expérience constitutionnelle algérienne a connu une pondération t claire du pouvoir exécutif, en particulier l’institution du Président de la République, qui a occupé et continue d’occuper une place juridique de premier plan dans le système politique algérien, compte tenu de l’importance que lui a accordée le fondateur constitutionnel, tant en termes de style de pouvoir et de façon qu’il occupe ses fonctions que des conditions requises pour le droit de se présenter, ou par son organisation du processus électoral menant à un mandat présidentiel qui a toujours constitué une fluctuation sur la question du lancement et de la restriction, ou par le grand élan des pouvoirs qu’il lui a donnés tous les deux. Dans des circonstances normales ou exceptionnelles, le rôle du Parlement et du Premier ministre a diminué, d’une part, et d’autre part, compte tenu de l’absence totale de la disposition sur sa responsabilité, ce qui rend difficile de déterminer la nature du système politique algérien car il prend toutes les mesures qui renforcent son statut juridique.
The Algerian constitutional experience has clearly seen a clear preference for the executive power, particularly the institution of the President of the Republic, who was and still occupies a prominent legal position in the Algerian political system, due to the importance attached to him by the constitutional founder, both in terms of the style of power and how he holds office and the conditions required for the right to run, or through his organization of the electoral process leading to a presidential term that has always constituted a fluctuation on the issue of launch and restriction, or through the great momentum of the powers he has delegated to him, whether in normal or exceptional circumstances, the role of parliament and the Prime Minister has declined, on the one part, and on the other hand, in the light of the complete absence of the provision on its responsibility, which makes it difficult to determine the nature of the Algerian political system as it takes every pattern that strengthens its legal status.
