Abstract:
هدفت هذه الدراسة إلى التعرف على ماهية العيوب الخاضعة للضمان في عقد البيع كون أن هذه العيوب تثير إشكالية بوجود عيب خفي قد يجهله المشتري في المبيع والتي قد تؤثر على المنفعة المرجوة من المبيع وتنقص من قيمته المادية أو المعنوية. كما وأشارت الدراسة إلى نطاق وأحكام الالتزام بضمان العيوب الخفية في عقد البيع.
وقد توصلت الدراسة إلى أن العيب الذي يستوجب الضمان القانوني هو تلك الآفة التي تصيب المبيع، فتجعله غير ملائم أو ينقص من قيمته المادية، أو يعوق استعماله العادي وهذا التعريف هو نتاج الاجتهاد الفقه والقضائي انطلاقا لما استقر عليه اجتهاد محكمة النقض المصرية. كما أن المشرع الجزائري لم يورد تعريف خاص بالعيب الخفي الموجب للضمان، شأنه شأن معظم التشريعات الأخرى، مكتفيا فقط بذكر الحالات التي يقوم فيها هذا الضمان وما يترتب على قيامه، وألحق حالة تخلف الصفة المشروطة في العقد بالعيب وأخضعها لنفس أحكامه بالرغم من الاختلاف بينهما.
This study aimed to identify the defects subject to the guarantee in the sales contract, since these defects raise a problem with the existence of a hidden defect that the buyer may be ignorant of in the sale that may affect the desired benefit of the sale and reduce its material or intangible value. The study also indicated the scope and provisions of the obligation to guarantee hidden defects in the sales contract.
The study concluded that the defect that requires legal guarantee is that scourge that affects the sale, making it inappropriate or reducing its material value, or hindering its normal use, and this definition is the product of jurisprudence and judicial jurisprudence based on the jurisprudence of the Egyptian Court of Cassation. Likewise, the Algerian legislator did not provide a special definition of the hidden defect requiring the guarantee, like most other legislations, contenting itself with mentioning only the cases in which this guarantee is based and the consequences of its implementation, and the case of the failure of the conditional characteristic in the contract is attached to the defect and subjected it to the same provisions in spite of the difference between them.
