السياسة الجنائية الدولية لحماية ضحايا الإتجار بالبشر

Abstract

یعد الاتجار بالبشر ثالث مشكلة إجرامیة تثیر قلق العالم بعد مشكلة الاتجار بالمخدرات والاتجار بالأسلحة وتمثل صور الجریمة المنظمة المركبة والمعقدة والخطیرة فهي مركبة لأنها تتكون من سلسلة الأفعال الجرمیة المختلفة وهي معقدة لأنها ترتكب بأسالیب تتسم بالدقة من جماعات إجرامیة غایة في التنظیم قد تتستر وراء أعمال یبدو أنها مشروعة وتلجأ لذوي السطوة لكي تخفي أنشطتها الإجرامیة وهي خطیرة بالنظر لما تخلفه من آثار وخیمة على أمن الدولة وكیانها الاجتماعي ونظامها الاقتصادي ولما تخلفه من ألاف الضحایا من الرجال والنساء والأطفال ولما لها من تأثیر مدمر على المجتمع الداخلي لذلك ینبغي أن تلقى مكافحة جریمة الاتجار بالبشر بصفتها شكل من أشكال الجریمة المنظمة ((عبر الحدود الوطنیة)) عنایة واهتمام خاص على المستوى الداخلي بقدر ما تحظى به من عنایة واهتمام على المستوى الدولي، ولعل أبرز هذه الجهود تظهر في ما حققته جهود هيئة الأمم المتحدة و محكمة الجنايات الدولية من مساعي في إرساء نصوص دولية تضمن حقوق الإنسان وحرياته ، ومن جهة أخرى إنشاء و تفعيل مؤسسات دولية تسهر على متابعة مجرمي الاتجار بالبشر وتعقب أثارهم. الملخص باللغة الإنجليزية: Trafficking in human beings third criminal problem of concern to the world after the problem of drug trafficking , arms trafficking and represents one of the images of organized crime vehicle and the complex and dangerous , they are a vehicle as it consists of a series of criminal acts different , which is complicated because they are committed in ways that is accurate and of criminal groups too in the organization may cover up behind the acts seem to be legitimate and resort for people with clout in order to conceal their criminal activities , a serious view of the failure of the disastrous effects on the security of the state and entity social and economic system , and to the failure of thousands of victims of men, women and children , and because of its devastating effect on society interior , so it should that received anti- crime of human trafficking as a form of organized crime ( ( transnational ) ) care and special attention at the domestic level by as much as Mathzy of care and attention at the international level and perhaps the most prominent of these efforts are reflected in the ones achieved by the United Nations and International Criminal Court to ensure human rights and the consecration of human rights and freedoms,on the other hand. The establishment and activation of international institutions to control the human trafficking criminals and trace their effects.
