Abstract:
يتناول هذا الموضوع الموسوم ب: الحبوس فيالجزائر خلال العهد الاستعماري وقضية فصل الدين عن الدولة مابين 1905-1954، و الحبوس لها مكانة كبيرة في الدين الاسلامي ولها وزن كبير في المجتمع الجزائري عبر التاريخ، ومثلت ميدان كبير لتنافس الجميع بمختلف شرائحهم حكاما ومحكومين، رجالا ونساء، و خاصة الدرجة التي وصلت اليها في العهد العثماني، سواء من ناحية الكم، او من ناحية الخد ما ت، لكن بدخول المحتل الفرنسي، اختلت منظومة الحبوس وتم تفكيكها بمراسيم وقرارات ظالمة، ادخلت بموجبها الى مصلحة املاك الدولة، ورغم المحاولات التي قام بها اهل العلم والصلاح، والغيورين على الدين الاسلامي ومقدساته لمنع ذلك، إلا أن الإدارة الاستعمارية، غلبت منطق المصلحة والمنفعة، على كل وعودها الكاذبة، بشأن الممتلكات والمقدسات، وواصلت إصدارها للقوانين للسيطرة والتحكم في المجتمع الجزائري. .
فموضوع دراستنا، يرمي الى محاولة معرفة الاسباب الحقيقية، لعدم سريان قانون فصل الدين عن الدولة، على الدين الاسلامي، رغم أن فرنسا دولة علمانية، والتعرف اكثر على الاسباب الحقيقية التى منعت تطبيق القانون في الجزائر، وخاصة وان مطلب استرجاع أملاك الحبوس تلازم مع تطبيق قانون الفصل.
