حماية الملكية الفكرية في البيئة الرقمية

Abstract

الملكية الفكرية هي فئة واسعة من حقوق الملكية ، توسعها مستمر بسبب إستمرار العقل البشري في إستحداث وسائل جديدة لترجمة إبداعاته. ما بدأ كبراءات اختراع كلاسيكية ومؤلفات مكتوبة ، أصبح الآن معلومات رقمية تعرض لأكبر جمهور ممكن وهو مجتمع الإنترنت الرقمي. تهدف هذه الدراسة إلى تسليط الضوء على الكيفية التي تتواجد بها الملكية الفكرية الصناعية الكلاسيكية في الفضاء السيبراني ، وكيف يمكن حدوث الإعتداء عليها ، ثم حقوق الملكية الأدبية والفنية (حقوق النشر) سواء تقليدية أو رقمية المنشأ ، حيث يوجد لهذا الأخير أنظمة جديدة معتمدة غير إعتيادية ، مثل نظام التعرف على المحتوى Content ID ، المستخدم من قبل شركة غوغل Google LLC الدولية ، لحماية هذه الحقوق من الهجمات الإلكترونية وأنواع الإعتداء الأخرى ، مثل نسخ المحتوى أو سرقته دون إحترام سياسة "الاستخدام العادل". Abstract : The intellectual property is a vast category of property rights, and its growth continues every time the human intellect innovates a new mean of transcending his creativity, what started as classic patents and written books, are now digital information displayed to the biggest possible audience which is the digital internet community. This study aims to shed light on how the classic Industrial Intellectual Property exist on the cyber space, and how can the violation occur, then the Copyrights, Traditional or Digital, where this latter has new unusual and accredited systems, like the infamous Content ID, used by the international Google LLC, to protect it from the cyber-attacks and other sorts of delinquencies, like copying or stealing content regardless of the “Fair Use” policy.
