Abstract:
يهدف البحث الحالي إلى معرفة دور المحامي والاستعانة به في مرحلة البحث والتحري,اشتملت الدراسة على جانب نظري وأخر ميداني , اعتمد في هذه الدراسة على المنهج التحليل القانوني يتخلله الوصف ومنهج القانون المقارن ولصحة الفرضيات قام الطالب طيباوي سعد بمقابلة شخصية للسيد وكيل الجمهورية و زيارة ميدانية لمصالح الشرطة , دراسة جداول إحصائية صادرة عن امن ولاية الجلفة , خلصت النتائج إلى : مرحلة البحث والتحري مرحلة سابقة للعمل القضائي , تكشف عن الجرائم والفاعلين والمساهمين ومنها تتحرك الدعوى العمومية , أحاطها المشرع بضمانات كافية لحماية الأفراد وحرياتهم .اختلاف وتباين التشريعات من حق الاستعانة بمحام في مرحلة البحث والتحري . تدخل غير كاف من المشرع الجزائري لإقرار حق الاستعانة بمحام حسب تعديل المادة 51 من ق ٳ ج ج . حضور المحامي لدى الضبطية القضائية لا يضمن حماية حقوق الموقوف لأن غرف الأمن الخاصة بالمحادثة قيد الانجاز في بعض المقرات الأمنية كما أن مدة 30 دقيقة غير كافية للمحامي لممارسة مهمته في بعض القضايا المتشعبة والمعقدة والخطيرة . المشرع لم يضمن للمشتبه فيه الغير مقتدر ماليا من توكيل محامي بواسطة المساعدة القضائية . لا يوجد نصوص تأديبية لضباط الشرطة القضائية المخالفين لحق الاستعانة بمحام, ولا نصوص إجرائية تقضي ببطلان التحقيق الأولي في حالات تجاوزات المحققين .

Summary:
The aim of this research paper is to know the lawyer s role and his assistance in the stage of research and investigation.The study contains two parts: a theoretical and a practical part.In this study, the legal analysis method was applied, interspersed with the description and the comparative law method.To prove the hypotheses, the student, Tibaoui Saad, conducted a personal interview with the republic prosecutor and he visited the police department of djelfa from which he got some statistics concerning this issue. The results are:The stage of research and investigation is prior than the judicial work and it reveals crimes and those who contribute to them and from which the public case moveThe legislator has provided this stage with enough measures to guarantee individuals freedoms. Legislations are different regarding the right to have a lawyer at the stage of research and investigation. The Act 51ACCPcannot fully guarrantee the detainee s right to counsel a lawyer at the stage of research and investigation.The presence of the lawyer at the judicial police does not guarantee the rights of the detainee, because some police offices do not contain rooms in which he can talk to the suspect. In some complex and serious cases, thirty minutes is not enough for a lawyer to accomplish his task.The legislator does not guarantee to the suspect - who is not financially able to hire a lawyer by the aid of the court .Police officers who violate the right of having a lawyer are not generally charged with that because there are no laws related to this issue.
