ﺍﻟﺮﻗﺎﺑﺔ ﺍﻟﻘﻀﺎﺋﻴﺔ ﻋﻠﻰ ﺩﺳﺘﻮﺭﻳﺔ ﺍﻟﻘﻮﺍﻧﻴﻦ

Abstract

تهدف هذه الدراسة الى تسليط الضوء على الرقابة القضائية على دستورية القوانين في ظل النظام الجزائري حيث تطرقنا في الفصل الاول إلى الجانب النظري للرقابة القضائية على دستورية القوانين، من خلال ماهيتها من مفهوم وصور وأنواع، ومميزات وعيوب لكل نوع ذكرناه حسب الآثار المترتبة عليها. واما في الفصل الثاني فقد تطرقنا إلى المحكمة الدستورية في ظل التعديل الدستوري 2020 من الناحية العضوية من خلال تشكيلتها وتنظيمها وخصوصا النظام القانوني لعضو المحكمة الدستورية، بالمقارنة مع الجانب العضوي للمجلس الدستوري في ظل التعديل الدستوري لسنة 2016.

This study aims to shed light on the judicial oversight of the constitutionality of laws under the Algerian regime. In the first chapter, we touched on the theoretical aspect of judicial oversight on the constitutionality of laws, through their concept, images, types, and advantages and disadvantages for each type we mentioned according to the effects on them. As for the second chapter, we discussed the Constitutional Court in light of the 2020 Constitutional Amendment in terms of membership through its formation and organization, especially the legal system of a member of the Constitutional Court, in comparison with the organic aspect of the Constitutional Council under the 2016 Constitutional Amendment
