المحكمة الدستورية وتحولات الرقابة الدستورية في الجزائر

Abstract

لقد شـــهد نظام الرقابة على دســــتورية القوانين في الجزائر عبر مســـــــار تطوره مراحـــــــل مختلفة بدأت مع تأسيس أول مجلس دستوري كهيئة مكلفة بالرقابة على دستورية القوانين في دستور 1962م، ليتم تعليق العمل بذلك في دستور 1976 مرورا بالتعديلات التي أقرت العديد من الإصلاحات على المجلس الدستوري و اضطلاعه بممارسة الرقابة على دستورية القوانين ( دستور 1989م و دستور 1969م) وصولا إلى المراجعة الدستورية الأخيرة لسنة 2020م، حيث أبانت عن التوجه و الانتقال من المجلس الدستوري إلى المحكمة الدستورية و بالتالي الاستغناء عن أسلوب الرقابة السياسية و الأخذ بأسلوب الرقابة القضائية على دستورية القوانين المعمول به في الكثير من الأنظمة الدستورية المقارنة، و هذا بموجب المادة 185 من التعديل الدستوري لسنة 2020م. الكلمات الافتتاحية : الدستور، الرقابة السياسية على دستورية القوانين، المجلس الدستوري، المحكمة الدستورية، الرقابة القضائية على دستورية القوانين، التعديل الدستوري لسنة 2020م.

Summary: The system of oversight on the constitutionality of aws in Algeria, through the course ofits development, has witnessed various stages, starting with the establishment oft he first Constitutional Council as a body charged with monitoring the constitutionality of aws in the 1962 constitution, to be suspended in the 1976 constitution through the amendments that approved many reforms on the Constitutional Council and its practice of oversight on the constitutionality ofl aws (Constitution of 1989 and Constitution of 1969) up to the last constitutional review of 2020, which indicated the trend and the transition from the Constitutional Council to the Constitutional Court and thus dispensing with the method of political control and adopting the method ofj udicial control over the constitutionality ofl aws in force in many oft he comparative constitutional systems, and this is in accordance with Article 185 oft he Constitutional Amendmentf or the year of 2020.
