تطور النظام القانوني للسلطة التنفيذية في ظل الدساتير الجزائرية

Abstract

السلطة التنفيذية هي المؤسسة المحورية التي تدور حولها الحياة السياسية والدستورية حيث انها تتكون من رئيس الجمهورية الذي أسندت له صلاحيات عديد في الدساتير السابقة وهذ راجع لأسباب تطرقنا لها في بحثنا هذا تناولنا السلطة التنفيذية في الدساتير الجزائرية السابقة وهذا كون أن الشيئ يعرف بتاريخه لذا تناولنا في الفصل الاول السلطة التفيذية في الدساتير الجزائرية السابقة وذلك بمبحثين عرجنا فيهم على اهم نقاط التعديل في السلطة التنفيذية عبر التطرق اليها في دستور 1963و 1976 والتعديل الدستوري 1988 ودستور 1989، ودستور1996ـ، والتعديل الدستور 2008، وتعديل 2016. اما في الفصل الثاني: عالجنا فيه اهم التعديلات التي مست السلطة التنفيذية بجهازيها رئيس الجمهورية في المبحث الاول، والحكومة في المبحث الثاني وذلك في نطاق التعديل الدستوري لسنة 2020 The executive authority is the pivotal institution around which political and constitutional life revolves, as it consists of the President of the Republic, who has been assigned many powers in previous constitutions, and this is due to the reasons we discussed in this research. We dealt with the executive authority in the previous Algerian constitutions, and this is because the thing is known by its history. Therefore, we dealt in the first chapter with the executive authority in the previous Algerian constitutions, with two topics. The 2008 Constitution Amendment, and the 2016 Amendment As for the second chapter: we dealt with the most important amendments that affected the executive authority in its two organs, the President of the Republic in the first topic, and the government in the second topic, within the scope of the constitutional amendment of 2020
