Abstract

تطرق الموضوع الى تحديد المنازعات الادارية، طبيعتها والاختصاص ومسألة ومعايير تحديد النزاع الاداري واجراءات التقاضي أمام القضاء الاداري، وسلطات القاضي الاداري سواء في مراقبة نشاط الادارة أو حماية حقوق الادارة. كما يتطرق الموضوع الى شروط الدعوى أمام القضاء الاداري وخصوصية المنازعة الادارية، وخلصت الدراسة الى تحديد موقف المشرع الجزائري من خلال قانون الاجراءات المدنية والادارية أو النصوص الخاصة المتعلقة بمجلس الدولة وتبنيه المعيار العضوي كأحد أهم معايير تحديد النزاع الاداري كأصل دون أن يهمل المعيار المادي.

The subject touched on defining administrative disputes, their nature, jurisdiction, issue and criteria for determining the administrative dispute, litigation procedures before the administrative judiciary, and the powers of the administrative judge, whether in monitoring the activity of the administration or protecting the rights of the administration. The subject also deals with the conditions of the case before the administrative judiciary and the specificity of the administrative dispute, and the study concluded to determine the position of the Algerian legislator through the Civil and Administrative Procedures Law or the special texts related to the State Council and its adoption of the organic criterion as one of the most important criteria for determining the administrative dispute as an asset without neglecting the material criterion.
