المساهمة الشعبية في مجال القواعد الدستورية في الجزائر

Abstract

إن التطورات السياسية الحاصلة في العالم وفي الجزائر خصوصا ، إنعكست على النصوص الدستورية منذ دستور 1963 الى غاية التعديل الدستوري لسنة 2020 . حيث أن دور الشعب في صناعة القواعد الدستورية إنشاً أو تعديلاً لم يخلو من طيات الدساتير المتعاقبة للجمهورية الجزائرية، بل تعدها الى حماية الفرد للقواعد الدستورية من خلال الآليات المستحدثة في التعديل الدستوري لسنة 2016 (الدفع بعدم الدستورية) ، والمحكمة الدستورية في التعديل الاخير. المؤسس الدستوري الجزائري أكد دور الشعب في النصوص بأنه صاحب السيادة ويرجع الأمر إليه كل ماكانت القضية ذات الأولوية والأهمية الوطنية التي تخدم الصالح العام وذلك بإبداء رآيه دون إكراه أو ضغوط وفق الأطر المتاحة والتي سطرها المؤسس الدستوري ووافق عليها الشعب.

The political developments taking place in the world, and in Algeria in particular, have been reflected to the constitutional texts from the first constitution of 1963 to the last constitutional amendment of 2020.

The participation of the Algerian people this context was notable, whether by creating or amending constitutional rules, it goes far beyond that by giving individuals a role in protecting constitutional rules through the mechanisms introduced in the constitutional amendment of 2016 (review by way of exception), and the Constitutional Court in the last amendment.

The Algerian constitutional founder affirmed the role of the people in the texts as he is the sovereign and it is up to him to do decide in everything of priority and national importance that serves the public interest, by expressing his opinion without coercion or pressure according to the available frameworks that the constitutional founder designed and approved by the people.

Les évolutions politiques qui ont lieu dans le monde, et en Algérie en particulier, se sont reflétées dans les textes constitutionnels depuis la première constitution de 1963 jusqu'au dernier amendement constitutionnel de 2020. La participation du peuple algérien dans ce contexte a été notable, que ce soit par la création ou la modification des règles constitutionnelles, elle va bien au-delà en donnant aux individus un rôle dans la protection des règles constitutionnelles à travers les mécanismes introduits dans l'amendement constitutionnel de 2016. (révision à titre exceptionnel), et la Cour Constitutionnelle dans le dernier amendement. Le fondateur de la Constitution algérienne a affirmé le rôle du peuple dans les textes car il est le souverain et c'est à lui de décider de tout ce qui est prioritaire et d'importance nationale et qui sert l'intérêt public, en exprimant son opinion sans coercition ni pression selon les cadres disponibles que le fondateur de la Constitution a conçus et approuvés par le peuple.
