الغيرية في السجل العقاري في التشريع الجزائري

Abstract

تعتبر" الغيرية"مصطلح فقهيمن أكثر المفاهيم تداولا وشيوعا،والذي يراد باستخدامه بصورة مطلقة تجنيب هذه الطائفة عدم الاعتراف بآثار التصرفات وفقا لما يقتضيه المنطق القانوني السليم أو القاعدة القانونية العامة. تهدف هذه الدراسة إلى إيجاد إطار نظري يحدد بصورة دقيقة الوجه الحقيقي للغيرية، من خلال تحديد مصطلح الغير في السجل العقاري، وكذا الحماية التي يحظى بها من خلال تمسكه بغيريته في مواجهة تصرفات مادية وقانونيةفي السجل العقاريالجزائري.

“Third party” is a legal termconsidered one of the most widely used and common concepts. The use of this concept is intended to avoidtherecognition of the effect of the contract as required by legal logic and general principles of law. This study aims to find a theoretical framework that accurately defines the true face of the third-party protection, by defining the term “the third party” in the real estate register, as well as the protection that he has through in the face of material and legal actions inthe Algerian real estate register.

« Le tiers »est un terme juridique considéré comme l'un des concepts les plus utilisée et des plus courants. Il est prévu d'utiliser ce concept absolument pour éviter que ce groupe ne reconnaisse pas les effets des actions en conformément à ce qui est requis par une saine logique juridique ou la règle de droit générale. Cette étude vise à trouver un cadre théorique qui définit avec précision le vrai visage de l'altruisme, à travers la définition du terme "tiers" dans le livrefoncier, ainsi que la protection dont il bénéficie à travers son adhésion à l'altruisme face aux actionsmatérielles etjudiciaire dans le livre foncier Algérien.
