Abstract

ملخص :

تناولت هذه الدراسة الأسرة الأندلسية و نبذة عن عاداتهم من خلال النوازل الفقهية ابن سهل ( ت 486 هـ ) أنموذجا ، حيث كانت الأسرة في المجتمع الأندلسي الخلية الأساسية الخاضعة للأحكام الفقهية و للعادات و التقاليد وبين أداء الواجبات و المطالبة بالحقوق حدثت مشاكل أسرية سجلت في ثنايا كتاب ديوان الأحكام الكبرى لأبي الأصبغ عباس بن سهل (ت 486 هـ) حيث أتبع هذه الدراسة المنهج التاريخي الوصفي ، و للإجابة على الإشكالية الرئيسية كيف تناول كتاب ديوان الأحكام الكبرى للأسرة في الأندلس ، ومن بين أهم النتائج : يعد كتاب ديوان الأحكام الكبرى أحد النوازل المعممة حيث تناول مواضيع عديدة متنوعة ، أهمها الأسرة و ذكر مسائل كثيرة مع حكمها الشرعي و العديد من فتاوى الفقهاء .

Résumé :

Cette étude traite de la famille andalouse et d'un aperçu de ses coutumes à travers les questions de jurisprudence Ibn Sahl (d. 486 AH) comme modèle, où la famille dans la société andalouse était la cellule de base soumise aux décisions jurisprudentielles, aux coutumes et aux traditions, et entre les l'exécution des devoirs et la revendication des droits, des problèmes familiaux sont survenus qui ont été enregistrés dans les plis du livre Diwan al-Ahkam al-Kubra d'Abi al-Asbagh Abbas bin Sahl (d. 486 AH), où cette étude a suivi l'historique descriptif approche, et pour répondre au problème principal comment le livre Diwan al-Ahkam al-Kubra a traité la famille en Andalousie, et parmi les résultats les plus importants : Le livre Diwan al-Ahkam al-Kubra est l'une des calamités généralisées où Il a traité avec de nombreux sujets divers, dont le plus important est la famille, et a mentionné de nombreux problèmes avec sa décision juridique et de nombreuses fatwas de juristes.

This study dealt with the Andalusian family and an overview of their customs through jurisprudence issues Ibn Sahl (d. 486 AH) as a model, where the family in Andalusian society was the basic cell subject to jurisprudential rulings, customs and traditions, and between the performance of duties and the claim of rights, family problems occurred that were recorded in the folds of the book Diwan al-Ahkam al-Kubra by Abi al-Asbagh Abbas bin Sahl (d. 486 AH), where this study followed the descriptive historical approach, and to answer the main problem how the book Diwan al-Ahkam al-Kubra dealt with the family in Andalusia, and among the most important results: The book Diwan al-Ahkam al-Kubra is one of the generalized calamities where He dealt with many diverse topics, the most important of which is the family, and mentioned many issues with its legal ruling and many fatwas of jurists.
