دور الحوكمة في تطوير إدارة الأوقاف : حالة الجزائر

Abstract

يعتبر الوقف في شريعتنا من بين أعظم القربات إلى الله، و من أهم سبل استمرار الأجر و الثواب، بالإضافة إلى الاستفادة المستمرة منه، و يقصد به "تحبيس الأصل و تسبيل الثمرة" –كما ورد في كتاب الوقف لأبي زهرة، و قد أكد على مشروعيته في الكتاب و السنة، إلا أن الاستغلال الأمثل للوقف يتم عن طريق إدارته سواء كان ذلك بشكل فردي أو جماعي، و لربما تعد الحوكمة من بين أنجع الطرق التي يمكنها تحقيق ذلك وفقا للشريعة الاسلامية، بل و تطويره بما يتماشى مع الظروف الاقتصادية و الاجتماعية الحديثة، من خلال تطبيق الشفافية و مبادئ الحوكمة التي أثبتت جدارتها في العديد من المجالات وفي مؤسسات عالمية كبرى، و هذا لا ينكر وجود نماذج لحوكمة الأوقاف في وطننا العربي رغم أنه ليس بحجم بعض الأوقاف الغربية المتطورة، إلا أنها تعتبر خطوة إيجابية نحو ترقية التوجه نحو هذا الطريق. و نظرا للظروف التي مرت بها بلادنا و التي مست المؤسسة الوقفية خصوصا إبان الاستعمار، قمنا بإجراء هذه الدراسة لمعرفة دور الحوكمة في تطوير إدارة الأوقاف في الجزائر، مستعملين المنهج التاريخي في سرد تاريخ إدارة الوقف في الجزائر سردا مفصلا، والمنهج الوصفي لعرض الجانب النظري للبحث، أما الشق التطبيقي لهذه الدراسة فتم باستخدام المنهج التحليلي الاستقرائي و الذي ارتأينا أنه متناسب مع طبيعة الموضوع، حيث قمنا بدراسة الحالة اعتمادا على معطيات احصائية وصفية من خلال المقابلة و الاستبيان. و قد جاءت هذه الدراسة بهدف التعرف على المشاكل الموجودة على مستوى إدارة الوقف في الجزائر و كيفية استعمال مبادئ و معايير الحوكمة في حلها و تنظيمها ، و ضرورة إعادة التفكير بشكل جدي في سبيل تطوير قطاع الأوقاف في بلادنا . و للتحكم في الموضوع بشكل مناسب تم تقسيم هذا البحث إلى أربعة فصول، جاءت مرتبة بطريقة مقصودة. فكان الفصل الأول حول ماهية الوقف و إدارة الوقف، أما الفصل الثاني فتضمن الجوانب الأساسية للحوكمة مع التطرق اليها من جانب شرعي، لنصل إلى صلب البحث في الفصل الثالث من خلال ابراز دور الحوكمة في تطوير إدارة الوقفمسترشدين في ذلك بنموذج حوكمة الأوقاف للشيخ محمد بن عبد العزيز الراجحي، أما الاضافة الشخصية للباحث تتمثل في الشق التطبيقي لهذه الدراسة حيث تم عرضه في الفصل الأخيرمن خلال تحليل معطيات الاستبيان و استقراء و تحليل اجابات المقابلة. على الرغم من أن تجربة حوكمة الأوقاف جديدة نسبياً إلا أنه ثبت ضرورة تطبيقها للنهوض بأوقافنا إلى مستوى يمكننا من الاتكال عليه في المشاكل الاقتصادية التي تواجهها الجزائر، و خصوصاً بعد الأزمة الاقتصادية الأخيرة، أين أضحت هذه الخطوة ملحة باعتبارها موردا مهما خصوصا في ظل البحث عن موارد جديدة للدولة.

Waqf in our law is one of the greatest means of rapprochement with God, and one of the most important means of being divinely rewarded, and aims to "endow the asset and generalize the utility" - as stated in the book of Waqf to Abu Zahra, and confirmed the legitimacy In the Qur'an and the Sunnah, however, the best use of the Waqf is its use either individually or collectively. Governance can be one of the most effective means of achieving this, in accordance with Islamic law, and even developed according to modern economic and social conditions. By the application of transparency and the principles of Governance which have proven themselves in many fields In large international institutions, This does not negate the existence of models of Governance of Waqf funds in the Arab world, although this this is not the case for some advanced Western Waqf funds, but it is a positive step towards promoting the trend towards this path.

Given the circumstances of our country, which affected the establishment of Waqf, in particular during the colonial period, we conducted this study to find out the role of Governance in the development of the management of Waqf funds in Algeria, in using a historical approach to detail the history of the administration of Waqf in Algeria and a descriptive approach to present the theoretical aspect of the research. For the applied part of this study, we used both analytical and inductive methods, we studied the case based on descriptive statistical data from the interview and the questionnaire. This study aims to identify the problems that exist in the management of Waqf funds in Algeria and how to use the principles and standards of Governance to resolve and organize them, as well as the need to seriously rethink in order to develop the sector of Awqaf in our country. To understand the subject well, this research has been divided into four chapters. The first chapter covers what isWaqf and the management of Waqf. The second chapter includes the fundamental aspects of Governance with a legitimate aspect. In chapter three we highlight the role of Governance in the development of the management of Waqf funds, guided by the model of Governance of Waqf funds of Sheikh Mohammad bin Abdul Aziz Al Rajhi, the applied part of this study, which was presented in the last chapter by analyzing the questionnaire data, extrapolating and analyzing the interview responses. Although the experience of the Governance of Waqfs is relatively new, it has proved necessary to implement it to advance our Waqfs to a level on which we can count on to solve the economic problems with which Algeria is confronted, especially after the recent economic crisis.

La Waqf dans notre loi est l'un des plus grands moyens de rapprochements avec Dieu, et l'un des moyens les plus importants pour être récompenser divinement, et vise à "immobiliser le bien et le mettre en usifruit " - comme indiqué dans le livre de Waqf à Abu Zahra, et a confirmé la légitimité Dans le Coran et la Sunna, toutefois, le meilleur usage du Waqf est son utilisation que ce soit individuellement ou collectivement. La Gouvernance peut être l’un des moyens les plus efficaces d’y parvenir, conformément au droit islamique, et même développée en fonction des conditions économiques et sociales modernes. Par l’application de la transparence et des principes de Gouvernance qui ont fait leurs preuves dans de nombreux domaines Dans les grandes institutions internationales, Cela ne nie pas l'existence de modèles de Gouvernance des fonds de Waqf dans le monde arabe, bien que ce ne soit pas le cas de certains fonds de Waqf occidentaux avancés, mais c'est un pas positif vers la promotion de la tendance vers cette voie. Compte tenu des circonstances de notre pays, qui ont affecté l’établissement du Waqf, en particulier pendant la période coloniale, nous avons mené cette étude pour connaître le rôle de la Gouvernance dans le développement de la gestion des fonds de Waqf en Algérie, en utilisant une approche historique pour détailler l’histoire de l’administration du Waqf en Algérie et une approche descriptive pour présenter l’aspect théorique de la recherche. Pour La partie appliquée de cette étude on à la fois utilisé des méthodes analytiques et inductives, nous avons étudié le cas en nous basant sur des données statistiques descriptives tirées de l’entretien et du questionnaire. Cette étude vise à identifier les problèmes qui existent au niveau de la gestion des fonds de Waqf en Algérie et comment utilisé les principes et les normes de Gouvernance pour les résoudre et les organiser, ainsi que la nécessité de repenser sérieusement afin de développer le secteur des Awqaf dans notre pays. Pour bien maîtriser le sujet, cette recherche a été divisée en quatre chapitres. Le premier chapitre porte sur ce qu'est la Waqf et la gestion de la Waqf .Le deuxième chapitre comprend les aspects fondamentaux de la Gouvernance ayant un aspect légitime. Au chapitre trois on souligne le rôle de la Gouvernance dans le développement de la gestion des fonds de Waqf, guidée par le modèle de Gouvernance des fonds de Waqf du cheikh Mohammad bin Abdul Aziz Al Rajhi, la partie appliquée de cette étude, qui a été présentée dans le dernier chapitre par l’analyse des données du questionnaire, l’extrapolation et l’analyse des réponses de l’entretien. Bien que l'expérience de la Gouvernance des Waqfs soit relativement nouvelle, il s'est avéré nécessaire de la mettre en œuvre pour faire progresser nos Waqfs à un niveau sur lequel nous pouvons compter pour résoudre les problèmes économiques auxquels l'Algérie est confrontés, en particulier après la récente crise économique.
